Welcome to Hayly, a modern marketplace connecting horse owners, buyers, and the equestrian community. By using Hayly, you agree to these Terms, our Privacy Policy, and, if you are a Founding Seller, the Founding Seller Agreement.
Terms of Service
1. General
- Hayly is a platform for posting and browsing horse listings, services, and events.
- By using the site, you agree to these Terms and our Privacy Policy.
- Hayly is currently in beta/early launch; features and traffic may be limited.
2. Marketplace Role
- Hayly is a marketplace platform, not a party to any transaction.
- We do not take ownership of horses or goods, handle payments, or guarantee sales.
- All sales, leases, or services are negotiated directly between buyers and sellers.
- Listings are provided by users; accuracy, fitness, or completeness is the responsibility of the seller.
3. User Accounts & Responsibilities
- Users must be at least 18 years old.
- Sellers must have the right to list horses or services they post and provide accurate information.
- Users are responsible for content they post and any taxes or obligations resulting from their transactions.
- Sellers must be prepared to honor the terms of their listings.
4. Content & Conduct
- Users must not post illegal, defamatory, abusive, obscene, or misleading content.
- Hayly may remove or edit listings at our discretion, including for legal compliance or user complaints.
- Users are responsible for obtaining permissions for photos or content they post.
- Community flagging: users can flag inappropriate listings; repeated reports may result in removal.
5. Indemnity & Release
- You agree to indemnify and hold harmless Hayly, its employees, and affiliates from any claims, damages, or losses arising from your use of the site or violations of these Terms.
- You release Hayly from any liability related to disputes between buyers and sellers.
6. No Guarantee
- Hayly does not guarantee sales, buyer interest, horse performance, or seller services.
- We recommend buyers perform a vet check or pre-purchase exam before completing any purchase.
- Users should do their own research and verification when engaging with others on the site.
7. Intellectual Property
- You retain ownership of your content.
- By posting, you grant Hayly a non-exclusive, royalty-free license to display your content on the platform and in marketing materials.
8. Monitoring & Cooperation
- Hayly may remove or refuse listings or users for any reason.
- We may cooperate with law enforcement or comply with court orders as needed.
- Hayly cannot review all listings in advance and is not responsible for user disputes, lost photos, or any transaction issues.
9. Governing Law
- These Terms are governed by the laws of California.
- You consent to the jurisdiction of courts in California for any disputes related to these Terms or use of Hayly.
10. Changes to Terms
- Hayly may update these Terms from time to time.
- Continued use of the site constitutes acceptance of any updates.
Founding Seller Agreement
1. Role & Responsibilities
- Provide accurate, complete information for your horse listings.
- Ensure you have the right to list any horse or service you post.
- Respond to buyer inquiries in good faith.
2. Founding Seller Benefits
- Free listings for all horses or services during the MVP phase.
- Priority placement in search results and on the homepage.
- Direct support from Hayly to create or improve listings.
- Opportunity to provide feedback and influence platform features.
3. Beta Disclaimer
- Hayly is in early launch/beta. Traffic and buyer activity may be limited.
- Participation is voluntary; no guaranteed sales or revenue are promised.
4. Content License
- By submitting listings, you grant Hayly a non-exclusive, royalty-free license to display your content on the platform and in marketing materials.
5. Termination
- Either party may terminate this agreement at any time.
- Hayly may remove listings or revoke Founding Seller perks for violations of the Terms of Service.
6. Liability
- Hayly is not responsible for transactions, disputes, or losses resulting from your participation.
